What is Lasting Power of Attorney?

Lasting power of attorney (LPA) is a legal document that lets you nominate a trusted person to make important decisions for you when you’re mentally or physically unable to do so. It covers financial or health and care matters, and is typically prepared long in advance to ensure you receive the best possible care.



Why do I need lasting power of attorney?

When you assign LPA, you have peace of mind that a family member or friend with your best wishes at heart will be there to take care of you. They’re able to make decisions regarding your finances, housing, social needs and welfare to ensure you’re as safe and comfortable as possible. Assigning LPA also relieves your loved ones of unnecessary emotional and financial strain.



What happens if I don’t assign lasting power of attorney?

If you lose the mental capacity to make decisions for yourself without LPA, your family will need to apply for deputyship through the Court of Protection. This is a long and expensive process that causes additional stress and anxiety at an already difficult time. And without the ability to manage your assets, they might not have the funds to care for you properly.

 

Once the application has been received, the Court will appoint a deputy on your behalf. However, unlike LPA, this deputy will only be able to make financial decisions, not health and care decisions. Instead, that duty will be assigned to social services.

 

Failing to assign LPA means you won’t receive the right attention and care when you truly need it. As a result, you and your loved ones are likely to endure unnecessary worry and suffering.
